David Huang
Senior Counsel


Mr. David Huang is the senior counsel of Lin & Partners, and focuses his practice on business and corporate matters, with specific emphasis on high-tech, IT, semiconductor and medical device industries. He advises clients on a wide range of areas covering M&A, strategic alliances, joint ventures, intellectual property/technology licensing and transfer, executive employment and compensation, and business formation and planning in relation to venture capital financing process.

Throughout his career, he has tried over 100 court hearings in Taiwan as a lead trial lawyer. David has also participated in judicial trials and commercial disputes in the United States, Germany, Switzerland, Brazil, Malaysia, Japan and Mainland China. In particular, David has unique experience in complicated b2b disputes, and is known for translating complex facts involving semiconductor and IT industry to the court.

David acted for a well-known IT company listed on Taiwan Stock Exchange in an ICC arbitration with Siemens AG. This arbitration, which related to the post-M&A dispute on purchase price adjustment, representations and indemnifications following the acquisition of a business unit from Siemens, was the biggest case in ICC in 2007 and 2008 in terms of target value. After the arbitration, David represented the company to settle with the German insolvency administrator of its German subsidiary in connection with claims underlying German stock corporation law as well as claw-back claims amounting to over €750 million in relation to the accounts receivable generated from product sales. In addition, David has been engaged in an US ITC action prevailing over Thomson Licensing SAS and Thomson Licensing LLC via an ITC final determination dated January 12, 2012 for their five asserted patents-in-suit, and represented a solar power solutions company listed on the Taiwan Stock Exchange in its negotiation with Merill Lynch Corporation for investments in its common stocks via private placement. For high-profile cases on the constitution level, David has petitioned to the Grand Justice of the Republic of China and successfully obtained partial nullification of Article 114 of the ROC Income Tax Act via Constitutional Interpretation No.673 (釋字第673號解釋).

David was admitted respectively in Taiwan in 1999 and State of New York in 2003, and passed the bar exam of the People’s Republic of China in 2016.

Early in his career, David practiced law at Lin & Associates Maritime Law Office and Lee & Li Attorneys-at-Law. He has also been an adjunct assistant professor at National Chiao-Tung University School of Law. Prior to joining Lin & Partners, David has served as Chief Legal Officer at Qisda Corp. (formerly known as BenQ Corp.).
